Statement of Billing Information as of January 7, 2006.
Payment Terms:
Users (hereinafter also referred to as “members,” “you,” or “your”) hereby agree to pay for the products and services they purchase on the WE SELL BUSINE$$ES (hereinafter also referred to as “WSB,” “the Company,” “we,” “us” or “our”) website with their Visa, MasterCard, Discover, or American Express debit or credit card in US Dollars. Accordingly, all users hereby grant WE SELL BUSINE$$ES authorization to charge and collect payment from your chosen debit or credit card provider for the products and services you purchase from us at the price specified on our website at the time of your purchase. Your payment of the charges imposed is not contingent on anything other than our delivering to you the products and services that you order from us. In the event that WSB must implement collection procedures in pursuit of delinquent, undisputed payments for those products and services, you will also be responsible for payment of all costs, including any court costs and attorneys’ fees incurred by the Company. Furthermore, we may immediately and without notice terminate delivery of any and all products or services that you have ordered from us.
WE SELL BUSINE$$ES grants Silver, Gold and Platinum membership privileges only to the individual providing their contact and credit card information. You cannot in any way assign, sublicense, distribute, share, or transfer your membership privileges nor shall you allow others to view or access our website using your membership privileges without our express written permission. We reserve the right to modify our Silver, Gold and Platinum membership plans from time to time which may change or limit the way you may add listings or search our database. In addition to any other remedies available to us, we can cancel or refuse membership privileges to any individual that fails to abide by the terms and conditions set forth herein. Specifically, we have the right to refuse service to any member that has unpaid, delinquent charges and to impose additional charges to bring your account current or to reactivate your membership.
WE SELL BUSINE$$ES will automatically renew your Silver, Gold, or Platinum month-to-month membership at the current monthly membership rate by charging the credit card number you provided at the time you joined our website or at the time you last upgraded your membership, whichever occurrence was most recent. In order to terminate your membership, you must notify us in writing within ten (10) or more days prior to your renewal date of your intent to terminate your membership. You must send your Notice of Intent to Terminate Membership to us via e-mail to billing@wesellbusinesses.us or by US Mail to “Billing Department, We Sell Businesses, Inc., 1400 Hubbell Place, Suite 613, Seattle, WA 98101.” When using the US Mail, we recommend that you send your notice using Certified Mail with a Return Receipt. If your Notice of Intent to Terminate Membership correspondence is not received in our offices within ten (10) or more days prior to your renewal date, we will not cancel your membership until the following renewal date of your membership. You may also give us Notice of Intent to Terminate Membership by calling the Company’s offices at (206) 344-4899 within ten (10) or more days prior to your renewal date. Upon our receipt of your Notice of Intent to Terminate, we will process your termination request within five (5) business days, and we will send you an e-mail confirming your termination request to the e-mail address currently registered to your account. Any other questions concerning your membership may be addressed to the Customer Service Department at billing@wesellbusinesses.us. Once we process your termination request, you will be unable to access your profile, listings, or any other website user products or services that we offer as of your renewal date.
WE SELL BUSINE$$ES may send out special promotional e-flyers containing a “Promotion Code.” Typically our e-flyers will offer a free trial for a certain period of time, usually 30 or 60 days. When you go to our website’s homepage and input the Promotion Code from the e-flyer, you will be taken to a page to join the website, which requires you to input your contact information along with your credit card information so that we may begin charging your credit card when the free trial period expires. Upon expiration of your free trial, your credit card will automatically be charged according to the membership plan under which you joined. In order to prevent billing at the end of the free trial period, you must send us your Notice of Intent to Terminate Membership—as specified in the preceding paragraph--within ten (10) or more days prior to the end of your free trial period, which will become your renewal date in the event you decide to continue your membership on our website.
Your monthly membership fees are non-refundable, regardless of whether you terminate your membership prior to the end of your current monthly billing period. In the event that we initiate prepayment options, we will then refund any prepaid fees based on the number of months remaining on your contract period as of the month following receipt of your Notice of Intent to Terminate Membership. We may adjust your refund based on our current monthly product and service pricing as well as for any incentives or discounts that we may have given you in return for your prepayment of our products and services. We do not provide members with partial month refunds under any circumstances.
You must promptly provide WSB with any new or changed contact or billing information, including your phone number, mailing address, e-mail address, and credit card numbers, etc. You may update the aforementioned account information by logging on to www.wesellbusinesses.us and going to the “My Account” tab within the “Member Home” area.
WSB reserves the right to change fees or payment terms at any time. We agree to give our members timely notice of any revisions to our fee structure or payment terms.
